1. Acceptance of Terms

By accessing and using The Story Shelf website ("Site"), you accept and agree to be bound by these Terms and Conditions and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Site.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes.

3.1 Our Content

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement) are owned by The Story Shelf, its licensors, or other providers of such material and are protected by Croatian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes. This license does not include any rights to:

• Modify or copy the materials
• Use the materials for commercial purposes or public display
• Remove any copyright or proprietary notations from the materials
• Transfer the materials to another person or mirror the materials on any other server

3.3 User-Generated Content

If you submit, post, or upload any content to the Site ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that such content does not violate any third-party rights or applicable laws.

4. Prohibited Uses

You may use the Site only for lawful purposes. You agree not to:

You acknowledge and agree that The Story Shelf shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

6. Disclaimer of Warranties

The Site is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. The Story Shelf does not warrant that:

• The Site will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Site is free of viruses or other harmful components
• The results of using the Site will meet your requirements

Your use of the Site is at your sole risk. To the fullest extent permitted by law, The Story Shelf disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Story Shelf, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid us, if any, during the twelve (12) months prior to the event giving rise to liability, or one hundred euros (€100), whichever is greater.

8. Indemnification

You agree to defend, indemnify, and hold harmless The Story Shelf and its licensors, affiliates, and their respective directors, officers, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Site
• Your violation of any rights of a third party
• Any User Content you submit, post, or upload to the Site

9. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Site will immediately cease. If you wish to terminate your account, you may simply discontinue using the Site or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Croatia.

If you are a consumer resident in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Site, the parties agree to first attempt to resolve the dispute informally by contacting us directly. We will make reasonable efforts to resolve the dispute within thirty (30) days.

11.2 Arbitration

If the dispute cannot be resolved informally, you agree that the dispute will be resolved by binding arbitration in accordance with Croatian arbitration law. The arbitration shall be conducted in English or Croatian, at your option, and shall take place in Croatia.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Privacy and Data Protection

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

We comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws. You have certain rights regarding your personal data as described in our Privacy Policy.

13. Changes to the Site

We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Story Shelf regarding the use of the Site and supersede all prior agreements and understandings.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

14.3 Waiver

No waiver by The Story Shelf of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

14.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent.

14.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control.

14.6 Language

These Terms are provided in English. Any translations are provided for convenience only. In case of any inconsistency, the English version shall prevail.
